When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
1. On January 21, 2016, at around 02:40, the Defendant: (a) discovered C, while causing an accident; (b) with the intent of causing an accident, having received insurance payments from an insurance company; (c) discovered C, while displaying the surrounding areas; (d) waiting at C’s vehicle; (c) the vehicle behind C was waiting for driving; and (d) reported to 112.
Fact that the accident did not occur.
Nevertheless, the Defendant, on January 22, 2016, dismissed the person in charge of compensation for the insurance company by means of having been hospitalized in Samsung-si E hospital located in Seocheon-gu, Seocheon-si after receiving an accident from Samsung Fire, which caused a traffic accident.
During the period from January 22, 2016 to October 30, 2014, the Defendant received 1,450,000 won as agreed money from the person in charge of compensation and 860,000 won as medical expenses, from the person in charge of compensation for the said insurance company who is aware of such fact, and acquired it by deception.
2. On October 21, 2016, the Defendant: (a) 02:44, the Defendant driven a drinking while driving on the street B in order to have C receive criminal punishment; and (b) filed a false report with C on 112.
The details of the report are as follows: "F new car was involved in an accident", and it is about to flee.
The report was filed with the aim of being punished for drinking driving by requesting a prompt mobilization, but in fact C did not have any fact of driving.
Nevertheless, the defendant had suffered an accident by driving under drinking at the same time and place as above.
C was dismissed.
