1. Defendant B made a donation contract on February 29, 2012 with respect to each land listed in the separate sheet to the Plaintiff (Counterclaim Defendant).
Reasons
1. Facts of recognition;
A. On May 11, 1939, the registration of ownership transfer was completed on August 14, 1938 in the name of the deceased D on May 11, 1939, when the ownership transfer registration was completed on the ground of family inheritance.
(Registration No. 9495 registry). (b)
1) On December 2, 1941, the land before the instant subdivision was partitioned into 114 square meters and 2,706 square meters, and the land before the instant subdivision was subdivided into 114 square meters and 2,706 square meters, and the land at 114 square meters before the F was the land specified in paragraph (1) of the attached Table, following the conversion of the area and the alteration of administrative districts. 2,706 square meters before the Gyeonggi E on April 25, 1950 was subdivided into 545 square meters and 333 square meters before G, 270 square meters before G, 294 square meters before J, 294, and 649 square meters before K.
C. On November 19, 1977, G 333 square meters became the land indicated in paragraph (2) of the attached Table after the Gyeonggi-do Lane 246 square meters was replaced by the implementation of the farmland improvement project on November 19, 197. 2) The 615 square meters before J was replaced by the Gyeonggi-Sesung-gun M&W 581 square meters due to the implementation of the farmland improvement project on November 19, 197, and became the land indicated in paragraph (3) of the attached Table.
1) The registration number No. 9495 was recorded on the land before the instant partition. However, the registration number No. 17149 was made on June 30, 1965, and the registration number No. 1795-7 (No. 5-1) was completed on January 28, 1980, and the registration number No. 1795-7 (No. 2) was again made on May 27, 196 in the name of the Defendant C on January 28, 1980.
3) However, on March 12, 1957 regarding the 615 J, the registration number 11568 (No. 5-3 of the evidence No. 5-2) was created, and the registration of ownership transfer was completed on March 12, 1957, the registration of ownership transfer under the name of D, the registration of ownership transfer under the name of C on March 12, 1957, and the registration of ownership transfer under the name of Defendant C on December 11, 1980.
