Defendant
A shall be punished by a fine for negligence of KRW 1,500,000, and by a fine of KRW 2,000,000.

Punishment of the crime
Defendant
A and Defendant B are drivers of D Cargo Vehicles.
The Defendants, along with G, the business owner of the “F station” in Yongsan-gu, U.S., U.S. as the owner of the “F station” in Ilyang-gu, U.S., in order to realize that the Defendants possessed the cargo driver welfare card for subsidizing fuel expenses paid to cargo drivers from the local government. G, the Defendants, who are cargo drivers, issued a credit card sales slip with the amount lower than the actual transaction amount in return for the Defendants to use the said gas station fixedly, set up a credit card sales slip and directly deliver the amount equivalent to the difference to the Defendants, and the Defendants, through the aforementioned credit card fraudulent transaction, recruited to receive a fuel subsidy from the local government.

On April 8, 2013, Defendant A: (a) provided the transit equivalent to KRW 476,00,000; (b) paid the paid-in amount using a new cargo driver welfare card as if it had paid-in totaling KRW 526,00,00; and (c) provided the victim YY as a credit card company with KRW 107,674 of the paid-in amount; and (d) provided the victim YY from that time to December 27, 2013 in the same manner, from that time, obtained pecuniary benefits equivalent to that of the paid-in amount, from that time to December 27, 2013, as indicated in the attached Table No. 96 to 149, supra, 53 times in total.

On May 2, 2013, Defendant B: (a) even though the Defendant provided transit equivalent to KRW 194,000, the Defendant paid the paid amount with the National Cargo Drivers’ Welfare Card as if he had paid the paid amount of KRW 224,00,00; and (b) had the Victim Bocheon-si pay KRW 47,221 as a credit card company, thereby having the Victim Bocheon-si paid the paid amount of KRW 47,221 as a credit card company; and (c) from that time to December 26, 2013, from that time in the same manner, he/she acquired pecuniary benefits equivalent to the said amount from that time to December 26, 2013.
