Reasons
1. Details, etc. of ruling;
A. The Governor of the Gyeonggi-do (1) as to the area of 153,790 square meters, etc. in Gwangju-si, Gwangju-si (D) as announced by Gyeonggi-do on September 5, 2008, the former National Land Planning and Utilization Act (amended by Act No. 9442, Feb. 6, 2009; hereinafter “former National Land Planning Act”).
Article 30 of the former Enforcement Decree of the National Land Planning and Utilization Act (amended by Presidential Decree No. 21038, Sep. 25, 2008; hereinafter “former Enforcement Decree of the National Land Planning and Utilization Act”).
Article 25(5) of the Framework Act on the Regulation of Land Use (amended by Act No. 9451, Feb. 6, 2009; hereinafter the same shall apply) shall determine and publicly notify an urban management plan (Class 1 district unit plan for alteration of Class 1 district unit planning zone) pursuant to Article 2
(2) On July 16, 2013, the Gwangju City announced E-ro, the decision on urban management planning of the D District and the decision on the topographical map (amended by the Presidential Decree) and the topographic map were published in accordance with Article 8(2), and the said district unit plan included the roads, such as 1-17 lines, among the infrastructure of the D District, in urban planning facilities.
3) The Gwangju City Mayor around October 2013 is the Defendant Han Assets Trust (former trade name: Hanol Trust Co., Ltd.; hereinafter “Defendant Trust”).
(B) On April 29, 2014, the instant project approval and the G block announcement were approved for the housing construction project for the zone H, I, and J block. On April 29, 2014, the instant implementation plan was approved by designating the project operator as the Defendant’s trust for the urban planning facility project (road) project (road) project (road) project (hereinafter “instant project”) project (road 1-17 and 13 routes) and the implementation plan was amended by the public announcement of the Gwangju City on November 24, 2014.
