[2019고단3513] 피고인은 2019. 9. 13. 07:40경 부천시 중동 이하 불상의 장소에서부터 부천시 B 앞 도로에 이르기까지 약 500미터 구간의 도로에서 자동차운전면허를 받지 아니한 채 술을 마신 상태에서 C 그랜져 승용차를 운전하다가 1차로에서 신호 대기 중 잠이 들었고, D지구대 소속 순경 E는 도로 1차로에서 움직이지 않는 차가 있다는 내용의 112신고를 받고 위 장소에 출동하여 술 냄새가 나고 얼굴에 홍조를 띠고 있었으며 음주감지기 사용결과 음주반응이 확인되는 등 피고인이 음주운전을 하였다고 인정할만한 상당한 이유가 있어 약 25분간에 걸쳐 피고인에게 음주측정기에 입김을 불어넣는 방법으로 음주측정에 응할 것을 요구하였으나, 피고인은 음주측정기에 입김을 불어넣는 시늉만 하고 음주측정에 응하지 아니하였다.
