A defendant shall be punished by imprisonment for one year.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

The defendant is a person who is engaged in driving a car in the C SP area.

1. On November 27, 2016, the Defendant violated the Road Traffic Act against the victim D (e.g., an accident) driving the said vehicle under the influence of alcohol content of 0.235% in the blood of around 00:10 on November 27, 2016, and driving the said vehicle to the intersection of the road front of the F Council members in Suwon-gu E in Suwon-si, Suwon-si.

At the time, the road was installed at night, and there was a duty of care to safely drive the vehicle according to the front line.

Nevertheless, the defendant, while under the influence of alcohol, was parked in the opposite direction of the defendant due to the negligence of driving the center line while under the influence of alcohol as above, he received the front portion of the G observer car owned by the victim D, which was parked in the opposite direction of the defendant.

Ultimately, the Defendant, by such occupational negligence, destroyed the victim’s options car amounting to KRW 2,834,200 for repair costs, but failed to immediately stop and take necessary measures, and escaped without any necessary measures.

2. Around November 27, 2016, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes against the Victim H (do referred to as the “Aggravated Punishment, etc. of Specific Crimes”), and violated the Road Traffic Act (hereinafter referred to as the “Cham”) with respect to the Defendant driving the said car at around 00:38, while under the influence of alcohol at around 00:235% of alcohol during blood, and driving the said car at around 0.235%, thereby driving it to proceed from the border hospital on the side of the Suchip Hospital.

At the time, it was night and there was a duty of care to safely drive a person engaged in driving service in accordance with the new code, because it was an intersection where signal, etc. is installed.

Nevertheless, the defendant, who violated the signal while under the influence of alcohol while the signal was red, shall follow the right-hand signals from the defendant's right-hand side of the direction of the proceeding.
