1. The Defendant shall pay to the Plaintiff KRW 130,00,000 and the interest rate of KRW 15% per annum from October 30, 2015 to the date of full payment.
Reasons
1.The following facts of recognition may be found either in dispute between the parties or in the entry in Gap evidence 1 to 17 (including branch numbers), by integrating the purpose of the entire pleadings.
1) Co., Ltd. (hereinafter referred to as “C”)
The E (hereinafter referred to as “instant commercial building”) on the ground D in Suwon-si, Suwon-si.
(2) The purpose of the instant commercial building development project is to develop real estate, etc. established for the development project, and the Plaintiff is the representative of C. 2) The Plaintiff is the executor of the instant commercial building development project, which has real ownership, such as the right to sell housing sites in the area D in Suwon-si, Suwon-si. The Defendant is a contractor awarded a contract for the instant commercial building development project
B. 1) C B B From April 19, 2013 to April 16, 2013, the amount of KRW 16 million per month (value-added tax is separate; hereinafter the same shall apply) between the Plaintiff and the Defendant.
(2) On October 2013, the Defendant entered into a contract for the instant commercial building development project with F to pay KRW 1,963,385,000, which is equivalent to the total sale amount of the 10th floor of the instant commercial building upon the completion of the construction of the instant commercial building. (2) After receiving a contract for the instant commercial building development project from F, the Defendant paid KRW 200,000 to the Plaintiff at the time of the request of the Plaintiff for advice and consultation on the performance and progress of the work related to the instant commercial building development project.
3. The Plaintiff provided the Defendant with data, such as the business plan, revenue and expenditure analysis sheet, cash flow sheet, selling price, sales marketing plan, etc. necessary for the instant commercial building construction project according to the contractor’s written agreement, and explained the plan. The progress and status of the instant commercial building construction project, the expected sale price, the status of consultation, and the sales marketing plan every day.
