Reasons
1. Basic facts
A. Defendant B Co., Ltd (hereinafter “Defendant B”) (hereinafter “Defendant B”) committed an agreement between Busan Metropolitan City and the Busan Metropolitan City on the management of the instant escalators to bear the electric charges, etc. required for the maintenance and management of Busan Metropolitan City, and the electrical charges, etc. required by the Defendant B, on March 2010.
B. The Plaintiff is a public corporation affiliated with Busan Metropolitan City, which is in charge of the maintenance and management of the instant escalator, and Defendant A is an individual entrepreneur who engages in elevator maintenance and repair business in the trade name of the E elevator.
C. On December 24, 2013, the Plaintiff entered into a service contract with Defendant A for the inspection, maintenance, and repair of the instant escalator (hereinafter “instant contract”) on a one-month basis, setting the contract period from January 1, 2014 to December 31, 2014 (1 year), and on one-month basis during the inspection period, and Defendant A performed the pertinent duties. Accordingly, Defendant A performed the pertinent duties. On December 23, 2014, the Plaintiff completed the last inspection of the instant local radar (hereinafter “instant inspection”), and completed the attached inspection of the Plaintiff’s local radar inspection sheet (including horizontal driving machines; hereinafter “instant inspection sheet”).

Upon the expiration of the instant contract, the Plaintiff entered into a service contract for the safety inspection, maintenance, and repair of the instant escalator on December 29, 2014 (hereinafter referred to as “Korea-style Elevator”) with the Korea-style Elevator Co., Ltd. (hereinafter referred to as “Korea-style Elevator”) during the contract period from January 1, 2015 to December 31, 2015 (1 year) and the inspection cycle once a month and set the first inspection date on January 13, 2015.
E. On January 9, 2015, the instant escalator was suspended due to the external impact of the passenger on January 9, 2015 (on the part of the passenger).
