피고인은 2019. 5. 25. 08:46경 전남 목포시 B에 있는 C 주점에서, 피고인의 남자친구 D이 E과 몸싸움을 하고 있던 중, 옆 테이블에 있던 피해자 F(20세)이 위 E과 일행이라고 오해하고 말려달라고 하였으나 피해자가 이를 말리지 않고 구경하며 웃었다는 이유로 화가 나, 피해자에게 “뭘 빠개냐(웃냐)”라고 외치며 근처의 탁자에 놓여 있던 위험한 물건인 소주잔을 집어 피해자를 향해 던져, 위 소주잔이 피해자의 무릎에 맞고 바닥에 떨어지면서 깨져 피해자의 오른쪽 새끼발가락에 그 파편이 튀게 하여 피해자에게 치료일수 미상의 절창상 등의 상해를 가하였다.
