1. Summary of grounds for appeal;

A. The sentence imposed by the court below against the Defendants (the fine of KRW 800,000,000 and the fine of KRW 4.5 million) is too unreasonable.

B. In light of the public prosecutor (Defendant B) 1) misunderstanding of facts (the degree of shock of the instant traffic accident, and the fact that the Defendant committed many similar crimes, etc., it is recognized that the Defendant acquired the insurance money by deceiving an insurance company even though the Defendant did not have suffered an injury due to the said traffic accident. Nevertheless, the lower court acquitted the Defendant on this part of the facts charged, thereby affecting the conclusion of the judgment. 2) The above sentence imposed by the lower court on Defendant B is too unreasonable and unreasonable.

2. Judgment on the prosecutor's assertion of mistake of facts as to Defendant B

A. The summary of this part of the facts charged is as follows: (a) Defendant B conspired with W in collusion with others, the occurrence of a traffic accident as described in paragraph (2) of the judgment below, and (b) Defendant B, despite the fact that Defendant B had not suffered an injury due to the said traffic accident, was hospitalized in BS Hospital on March 22, 2016, thereby deceiving AB of the victim by deceiving the victim on March 25, 2016, and by deceiving the victim of the agreement amount of KRW 950,000 from the victim.
