1. Revocation of a judgment of the first instance;

2. The plaintiffs' claims are dismissed.

3. The costs of the lawsuit are assessed against the Plaintiffs.

1. Facts of recognition;

A. 1) On April 7, 2010, the Plaintiffs purchased the building with the 28/36m2 of shares of Plaintiff A and the 2nd floor above that of Plaintiff C, Gangnam-gu, Seoul, with the 239m2 and 8/36m2 of shares of Plaintiff B, and registered the ownership transfer on May 20, 2010. (2) The Plaintiffs removed the above building and newly constructed the building with the 1st floor above, the 28/36m2 of Plaintiff A’s shares and the 36m2 of Plaintiff B’s shares on the said land (hereinafter “instant building”). The Plaintiffs were to share the building with the 28/36m2 of Plaintiff A’s shares and the 36m2 of Plaintiff B’s shares on the said land, and obtained a building permit from the Defendant on December 18, 2013.

3) On March 4, 2014, the Plaintiffs: (a) Danam Construction Co., Ltd. (hereinafter “Danam Construction”); and (b)

(B) On October 2014, Danam Construction contracted the instant building, and around October 2014, Danam Construction completed the instant building. (B) On October 8, 2014, an architect D who represented the Plaintiffs prepared an application for approval of use of the instant building and submitted it to the Defendant on October 8, 2014. The said application erroneously stated that the Plaintiffs were 50/10 shares of the instant building.

2) 이에 따라 피고는 2014. 10. 14. 이 사건 건물에 대한 사용승인을 하고 건축물대장을 작성하면서 「소유자 현황」란에 원고들이 이 사건 건물을 100분의 50 지분씩 공유하는 것으로 기재하였다. ◆ 구 「건축법」(2015. 1. 6. 법률 제12968호로 개정되기 전의 것) 제22조(건축물의 사용승인) ① 건축주가 제11조ㆍ제14조 또는 제20조 제1항에 따라 허가를 받았거나 신고를 한 건축물의 건축공사를 완료(괄호 부분 생략)한 후 그 건축물을 사용하려면 제25조 제5항에 따라 공사감리자가 작성한 감리완료보고서(괄호 부분 생략 와 국토교통부령으로 정하는 공사완료도서를 첨부하여 허가권자에게 사용승인을 신청하여야 한다.
