1. The Defendant’s KRW 83,836,191 as well as 5% per annum from June 10, 2015 to June 8, 2017 to the Plaintiff.
Reasons
1. Occurrence of liability to pay mutual aid benefits;
A. Facts of recognition 1) The Plaintiff was a student attending the Yangju High School located in Yangju-si in Yangju-si, around 2014.
B) The Defendant’s Act on Prevention of and Compensation for School Safety Accidents (hereinafter “School Safety Act”)
(2) On September 18, 2014, the Plaintiff, a corporation established pursuant to the head of the Yangju High School, is a business operator of the school safety accident compensation deduction to which the head of the Yangju High School has subscribed. (2) On September 18, 2014, when the Plaintiff moved to a string game in the playground of the Yangju High School as a sports class and moved to a string to catch a string and landing place (hereinafter referred to as the “instant accident”).
(B) In relation to the instant accident, the Plaintiff claimed for medical care benefits pursuant to the School Safety Act against the Defendant in relation to the instant accident, and the Defendant recognized that the instant accident constituted a school safety accident under the School Safety Act.
3) On March 19, 2015, the Plaintiff underwent a stress radiation test at a wooden hospital affiliated with the Gandong Hospital affiliated with the Ganman University of Ganman University. As a result of the said test, the front section of the right slot was confirmed to be nine meters right and two meters left, and accordingly, the Plaintiff was diagnosed as a person who has a permanent obstacle to one of the three sections of the three sections of a bridge under the State Compensation Act.
B) On April 26, 2017, in the procedure of physical appraisal entrustment with the Plaintiff, implemented at the request of this court, it was confirmed that the front part of the right sleep was about 6.2 meters ( approximately 7.2 meters on the left part) compared to the left part in the front part of the ewton in the state of 35 degrees ewn 35 degrees ewn, in the process of physical appraisal entrustment with the Plaintiff, through Tslol. The physical appraisal is one of the three major sections of the bridge, "Article 16.1 of the Enforcement Decree of the School Safety Act and subparagraph 7 of the attached Table 2 of the attached Table 2.
