A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Around December 8, 2019, the Defendant posted a false statement to the effect that he/she had access to the Internet B website by using a mobile phone and sold the “radiophone” at an unspecified place, and reported it to the victim C who visited the victim C by “to send the money first.”
However, in fact, the defendant did not possess the above goods, and there was no intention or ability to sell the money even if he received the money from the victim because he thought to acquire the money by deceiving the buyers of the goods.
The Defendant received KRW 93,00 from the victim to the D bank account in the name of the Defendant from December 17, 2019, for the same day, a total of KRW 273,000 from the victims, as shown in the attached Table 1, from the time when the Defendant received transfer of KRW 93,00 from the victim as the price for the goods in the same day.
Accordingly, the defendant was informed of the victims to receive each property.
Around December 17, 2019, the Defendant posted a letter to the effect that he/she sells “Trigalgal lusium (Blusopon)” by accessing the Defendant’s residence to the E building and the Internet B site in the U.S., and reported it to the victim G who visited him/her, stating that “I will forward the price first.”
However, in fact, the defendant did not possess the above goods and thought that he acquired money by deceiving the buyers, so even if he received money from the victim, he did not have any intention or ability to sell it.
Nevertheless, the Defendant: (a) by deceiving the victim as above; (b) received transfer of KRW 90,00 from the D bank account (Account Number: H) in the name of the Defendant for the same day from the victim; and (c) received from the victims totaling KRW 434,50,00 from the victims, from January 11, 2020, as shown in the attached List 2.
