Punishment of the crime

No person, other than members and employees of the Gu/Si/Gun Election Management Committee, members and employees of the superior election commission, and persons who cooperate with the ballot counting affairs, and ballot counting witnesses, shall enter the ballot-counting place.

1. Notwithstanding the fact that Defendant A was the head of the election affairs of Defendant E for the elected party of the 7th local election district council members of the Gu/Si/Gun election management commission and members and employees of the Gu/Si/Gun election management commission and its superior election commission, and ballot-counting cooperation personnel and ballot-counting cooperation personnel of the ballot-counting commission, Defendant A entered the 7th local election district election management office established on June 13, 2018, as stated in the indictment “2:46 constituency” in the indictment around 22:25, 2018 (see Supreme Court Decision 2001Do970, Mar. 15, 2002), and entered the above ballot-counting office at around 23:03, and around 23:36, respectively.

Accordingly, the Defendant entered the 7th local election d-gu ballot-counting place via the above 3 times in total.

2. Defendant B worked as a volunteer for the election campaign in Seoul Special Metropolitan City’s 7th local election campaign. Defendant B entered the 7th local election D ballot-counting office established on June 13, 2018 and around 23:12, respectively, even though the former and Si/Gun election management committees, members and employees of the superior election commission, ballot-counting clerks, and ballot-counting cooperation employees and ballot-counting witnesses.

Accordingly, the Defendant entered the 7th local election d-gu ballot-counting place via the above two times in total.
