Reasons
Punishment of the crime
1. The Defendants’ co-principal
A. From December 24, 2012 to December 4, 2013, Defendant A borrowed money from D on eight occasions and received interest from D. On January 24, 2014, Defendant A had the intent to make a proxy form of D with the defect in the name of D and to enforce compulsory execution against D’s property without paying the borrowed money. Defendant B, along with D, lent money from Defendant B, with D, “If she escaped, she would have not repaid D’s debt even if she would have not repaid D’s debt.” Defendant B consented thereto.
On January 14, 2014, the Defendants: (a) a notary public located in Dobong-dong, Seoul, Gwanak-gu, Seoul; (b) Defendant A made the proxy form in D to prepare a notarial deed for a monetary loan contract; (c) Defendant B made the proxy form in D to Defendant B; (d) Defendant B made the proxy form in D to commission the preparation of a notarial deed for a monetary loan contract; (d) “B”, “B,” “B,” “A,” “A,” “D,” “E, and “B,” and “D” to the creditor column; and (d) affixed a seal imprint on D’s name; and (d) made the proxy form in D to delegate all the authority to commission B to prepare a notarial deed for a monetary loan contract under the above conditions.
Accordingly, for the purpose of exercising authority, the Defendants forged a letter of delegation in the name of D, a private document on rights and obligations.
B. The Defendants at the same time and place as referred to in the preceding paragraph submitted the forged D’s power of attorney to the above notarial office, which may not know the forgery, as if they were genuine.
As a result, the Defendants conspired to use a falsified investigation document.
2. The maximum interest rate under the contract for borrowing and lending of money to the sole offender by the defendant A shall not exceed 30 percent per annum;
