The judgment below
Part concerning Defendant F, H, and I shall be reversed.
Defendant
F and H are subject to each fine of KRW 20 million.
Reasons
1. Summary of grounds for appeal;
A. Defendant A, C, D, E, F, G, H, and I’s sentence imposed by the lower court on the Defendants (Defendant A: 4 years of the suspended sentence in two years and six months of imprisonment; 3 years of the suspended sentence in one year and six months of imprisonment; 2 years of the suspended sentence in one year and six months of imprisonment; 2 years of the suspended sentence in one year of imprisonment; 2 years of the suspended sentence in two years of the suspended sentence in each of the imprisonment, 2 years of the Defendant F, H, and I: 6 years of the suspended sentence in each of the imprisonment) are too unreasonable.
B. The sentence imposed by the prosecutor against Defendant A, B, and C is too unfased and unreasonable.
2. Determination
A. Defendant A’s each of the instant crimes against Defendant A, B, and C is the representative director of P Co., Ltd. (hereinafter “P”), Defendant B is the chief of P Quality Control Team, Defendant C is the vice chief of P Quality Control Team, and Defendant C is in collusion with its subordinate employees to enter into a contract for new construction works of nuclear power plants of new 1 and 2 and to supply a well-surling posters with its affiliated companies. From that point of view, Defendant ASTM’s delivery of raw materials of the ASTM standard and the delivery of inspection certificate accordingly was requested. However, even though the U.S. military court failed to have such standard materials and make it difficult to deliver the standard products upon such request, it is recognized that it was necessary to punish the act of deceiving damage to the company by altering the content of the ASM standard and to punish the supply price of nuclear power plants to the extent that it could be easily used through the alteration of the contents of the ASM standard, and that it is necessary to punish the amount of supply price of nuclear power plants to the extent that it could be used.
However, the above defendants did not observe the law.
