피고인들은 성명불상 보이스피싱 조직원이 인터넷 포털사이트 ‘C’의 ‘죽을 용기로 같이 일하실 분, 밑바닥인 분들 오세요ㅠ’ 카페에 게시한 ‘2인 1조 수금직원을 구한다’는 내용의 게시글을 보고 위 성명불상 보이스피싱 조직원에게 연락하여 수금직원을 하기로 한 다음, 성명불상 보이스피싱 조직원들은 국내에 있는 피해자에게 전화를 걸어 금융감독원 직원을 사칭하면서 ‘현금을 인출한 다음 금융감독원 직원에게 전달하라’고 기망하는 역할, 피고인 A은 국내에서 금융감독원 직원인 것처럼 행세하며 피해자를 만나 현금을 건네받는 역할, 피고인 B은 피고인 A이 중간에서 돈을 가로채는 일이 없도록 보이스피싱 조직원들이 있는 중국 칭다오로 가 볼모로 잡혀있는 역할을 각각 담당한 후 수익금을 나누어 갖기로 공모하였다.
