Punishment of the crime

1. Defendant B is a person who acts for Defendant A as the director of the construction site of the E elementary school kitchen located in Chuncheon City D and the construction site of the restaurant extension work site.

The business owner shall take measures necessary for the prevention of hazards in the places where workers might fall down at work, where sand, structures, etc. might collapse, where material objects might fall or come by flying, where other hazards may occur in the course of work due to natural disasters.

Where a business owner installs a temporary passage, he/she shall install a solid structure, and a slope shall be built not exceeding 30 degrees, and where the slope exceeds 15 degrees, a safe rail shall be installed in a place likely to fall, and where the length of the passage installed in the vertical tunnel is not less than 15 meters, a stairs witness shall be installed within 10 meters, and a stairs witness shall be installed within 7 meters in a rain bridge the height of which is not less than 8 meters used for construction works.

Nevertheless, at around 15:00 on September 24, 2012, Defendant B did not install a safety rail on both sides of the temporary stairs on the rooftop of the construction site.

When a business owner installs a work plate at a place of work, the height of which is not less than 2 meters, he/she shall use it as solid so that it may withstanding the load of the materials at the time of the work, the width of the work plate shall be not less than 40 centimeters, the gap between the launching materials shall be not more than 3 centimeters, the safety distress shall be installed at the place where there is a danger of fall, the support of the work plate shall be used, and the work plate shall be connected or fixed to not less than two support materials so that it is not likely to be destroyed by the underwater, and shall take measures necessary for prevention of danger shall be taken where the work plate is moved according to the work.
