Reasons

Punishment of the crime

[2015 High 1195] The Defendant is an employer who operates a service business (private) by making use of nine full-time workers as a business owner who is located in Category C (State) with the 105 branch floor of the building B in Ansan-si, Ansan-si.

When a worker dies or retires, the employer shall pay the wages, compensations, and other money and valuables within fourteen days after the cause for such payment occurred.

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant, at the same place of business, worked from August 1, 201 to November 30, 2014 in E’s 2012, 583,200 won for unused annual paid leave, 625,200 won for unused annual paid leave in 2013, 66,880 won for unused annual paid leave in 2014, and 1,875,280 won for unused annual paid leave in 2014 and from March 7, 2015.

4. F’s total amount of money and valuables KRW 4,035,280, including the said two money and valuables of KRW 2,160,000, working until April 27, 2015, which were not paid within 14 days from the date when the grounds for the payment arose without agreement between the parties to the extension of the payment date.

1. When a worker retires, the employer in violation of the Labor Standards Act shall pay him/her wages within fourteen days after the cause for such payment occurred;

Nevertheless, the Defendant worked at the said workplace from October 3, 2010 to October 8, 2014, and was retired from the said workplace and did not pay 1,435,640 won for August 8, 2014 of his/her retired worker H, as well as 3,314,510 won for the total amount of wage of 1,435,640 won for September 201, and 443,230 won for the portion of October 2014, and 3,314,510 won for the amount of wage of 1,194,150 won for the retirement worker E within 14 days from the date of his/her retirement without an agreement on the extension of the date.

2. An employer who violates the Guarantee of Workers' Retirement Benefits Act shall, in case where a worker retires, pay the retirement allowance within fourteen days after the cause for such payment occurred; and
