A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (U.S.) and the Road Traffic Act (U.S.) are those who are engaged in driving B rocketing cars;
On April 8, 2015, at around 02:00, the Defendant driven the said car under the influence of alcohol level of 0.149%, and led to the driving of the said car in front of the Driju station located in Gyeonggi-si, in the direction of the Triju.
At that time, the center line of yellow-ray is installed, so a person engaged in driving service has a duty of care to live well in the front line and to safely operate the car line.
Nevertheless, the Defendant, while under the influence of alcohol, was negligent and went beyond the center line, was driven by the victim E(the age of 49) who was driving on the opposite part of the F Kan-kin-knife's left-hand side of the Defendant's driver's car.
Ultimately, the Defendant, by negligence in the course of performing such duties, avoided injuries to the victim E (the 49-year-old), the victim G (the 47-year-old), the victim H (the 47-year-old), and I (the 36-year-old-old-old-old-age), each of which requires two weeks medical treatment, and escaped without taking necessary measures, such as aiding and abetting the 152,000 won of repairing expenses, such as exchange and maintenance of livers.
2. The Defendant violated the Road Traffic Act (driving) driven the said rocketing car under the influence of alcohol by 0.149% in blood alcohol concentration in front of the restaurant in the Ori-dong, Ori-dong, Ori-dong, “Dulullar” to the front day of the Hahulel.
