A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

피고인은 2018. 6. 2. 19:28 경 수원시 장안구 C 앞 길에서, 구걸을 하는 사람이 있다는 내용의 112 신고를 받고 그곳에 출동한 수원 중부 경찰서 D 지구대 소속 경위인 피해자 E(47 세) 가 피고인에게 구걸 행위로 처벌 받을 수 있으니 짐을 챙겨서 귀가 하라고 하자, 손에 들고 있던 위험한 물건인 끝이 뾰족 한 쇠 막대기( 길이 약 13cm )를 피고인이 앉아 있는 나무 의자에 수 회 내려찍다가 위 쇠막대 기를 피해자를 향해 찌를 듯이 겨누어 협박하고, 이에 피해 자가 피고인으로부터 위 쇠 막대기를 빼앗고 피해자와 함께 출동한 위 지구대 소속 순경 F이 피고인이 도로에 깔아 놓은 짐을 정리하려고 하자 욕설을 하면서 위 F에게 달려들고, 이를 제지하는 피해자에게 주먹을 휘두르고, 손톱으로 피해자의 왼쪽 팔뚝을 할퀴고, 피해자를 밀쳐 그 과정에서 피해자가 자신이 들고 있던 위 쇠 막대기에 오른쪽 엄지손가락이 찍히게 하였다.
