Defendant shall be punished by imprisonment for a year and six months, and a fine of fifty thousand won.

The defendant does not pay the above fine.

Punishment of the crime

1. Any person who intends to conduct foreign exchange business in violation of the Foreign Exchange Transactions Act shall prepare sufficient capital, facilities and human resources to conduct foreign exchange business and register with the Minister of Finance and Economy in advance, as prescribed by Presidential Decree;

On April 13, 2014, the Defendant did not obtain registration from the Minister of Strategy and Finance, and received a request from D, the requester for the money exchange, for the money exchange in Korean currency, at a place not exceeding the Republic of Korea, on April 13, 2014, for the money exchange amounting to KRW 6 million,005,00 from E’s bank account (F) to D’s account. From June 8, 2016, the Defendant engaged in the money exchange business without registration by transferring KRW 17,423,126,985 in total from the money exchange clients to the money exchange account under the name of D.

B. On April 13, 2014, the Defendant did not obtain registration from the Minister of Strategy and Finance, and carried on unregistered foreign exchange business by receiving KRW 17,408,124,267, total amount of KRW 17,309,000 from the Defendant, who paid the money to the money exchange requester 3,309 times in total, while paying the money to the money exchange requester 17,408,124,267 won in total, from the time to June 9, 2016.

2. No person who violates the Electronic Financial Transactions Act shall transfer or take over any access medium related to financial institutions, except as otherwise expressly provided for in any other Act, and shall lend or lend any access medium, or store, deliver or distribute such medium while receiving, demanding or promising to provide compensation;
