1. The Defendants are jointly and severally liable to the Plaintiff for 40,000,000 won and 5% per annum from July 31, 1996 to August 16, 2004.

According to Gap evidence No. 1, there is no dispute between the parties or according to the plaintiff's statement, the plaintiff lent the loan to the defendant Eul by July 30, 1996. The defendant C, the husband of the defendant Eul, was jointly and severally guaranteed the above loan debt, and the plaintiff received the judgment of Busan District Court Decision 2004Da95760, Dec. 1, 2004 and the above judgment became final and conclusive at that time. Thus, the claim of this case is justified.
