A defendant shall be punished by imprisonment for four months.
Reasons
Punishment of the crime
[Criminal record] On April 6, 2017, the Defendant was sentenced to ten months by the Seoul Western District Court for aiding and abetting the use of computers, etc., and the said judgment became final and conclusive on June 8, 2017.
[2] On August 1, 2015, the Defendant, despite being aware of the fact that the account was used for receiving money from a bank account with which he/she can receive money from a person without his/her name, provided that he/she knew that the account was used to receive money from a person with no name, and provided information to the person with no name, upon permission for the use of the community credit cooperative account (E) and the F’s bank account in the name of the Defendant’s seat.
1. On July 30, 2015, the name influor of assistance in fraud to the victim H made a false statement to the effect that “When sending money to repay the existing loan, it is intended to give a loan at a low interest rate to the victim H by calls from the victim H without any intent or ability to give a loan at a closed place,” and that it was transferred KRW 1,281,00,000 to the Saemaul Treasury Account (J) in the name of I on July 30, 2015 from the damaged person, as well as KRW 70,000,000 to the Saemaul Treasury Account in the name of D on August 13, 2015.
Since then, on August 15, 2015, the Defendant: (a) ordered the said D to withdraw KRW 700,000 deposited into the account under the said D’s name on August 15, 2015; and (b) deposited the said money to the SC Japan bank account under the name of the said K designated by the said non-titled person; and (c) made it easy for the Defendant to commit the crime of fraud of the non-named person.
2. On September 11, 2015, the name influor of assistance in fraud against the victim M makes a false statement to the effect that “I would give a loan at low interest to the victim M without any intent or ability to give a loan at a closed place,” and misrepresenting the victim M with the intent of “I would give a loan at a low interest if I would give the money to repay the existing loan.” This is the name of N on the same day from the victim.
