All prosecutions against the Defendants are dismissed.

1. Summary of the facts charged

A. Defendant A is a spouse who has completed a marriage report with D on May 2, 1996.

At around 23:40 on February 18, 2014, the Defendant sent to the B with a single sexual intercourse within the area of 512, Gwangju Mine-gu E. 512.

B. Defendant B knew that the above spouse was a spouse, and even at the same time and place as in paragraph (1) above, the above Defendant was sexual intercourse with A once.

2. Determination and conclusion

(a) An offense subject to prosecution upon complaint: Article 241 (2) of the Criminal Act;

B. Revocation of each complaint filed by D after the prosecution of this case

(c) Subparagraph 5 of Article 327 of the Criminal Procedure Act: Rejection of prosecution; and
