A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

E and F, a similar receiving company, E and F, from around August 2015, a similar receiving company, recommended investment in the above company and recruited or solicited subordinate investors from an unspecified number of unspecified investors. G, upon receiving a proposal from F to invite them to invite members to invest in the fund from around September 2015, G, a person who participated in the activities as the head of Gangnam Branch of the above company and solicited unspecified persons to invest in D and invite subordinate investors. As the Defendant invested in the above company at the invitation of G around October 22, 2015, it conspired with the above investors to receive investment money under the pretext of receiving investment money equivalent to 200% of the investment money by operating shopping mall from subordinate investors.

Accordingly, the Defendant, along with E, F, G, etc., did not obtain authorization, permission, registration, reporting, etc. from the competent authorities, and on December 11, 2015, at the above branch offices located under the first floor of the building underground in Gwanak-gu, Seoul Special Metropolitan City, the Defendant is entitled to receive the investment from I to a maximum of 90,000 won from D (one unit) to a maximum of 110,000 won. Upon paying the investment, the Defendant is entitled to receive the investment from 20% every day from the day after the payment of the investment is made, and the profits are paid every day until 200% of the amount of the investment made by the subordinate investors, 30% of the principal of the investment made by the subordinate investors, 20% of the principal of the investment made by the subordinate two investors, 20% of the principal of the investment made by the subordinate three to five, and 10% of the amount of the investment made by the said investment.
