1. As to KRW 57,00,000 among the Plaintiff and KRW 5,000,000, the Defendant shall pay to the Plaintiff KRW 52,000,000 from July 11, 2015.

1. Facts of recognition;

A. The Plaintiff, while promoting the domesticization of the air conditioners energy reduction system, was admitted into the Republic of Korea as a director, and was appointed as a representative director on October 10, 2013 when establishing D (hereinafter “D”).

나. D는 2014. 2. 6. C을 통해 알게 된 피고에게 에너지절감기(2.5RT)의 쳄버테스트를 위탁한 후, 같은 달 14.부터 2014. 4. 16.까지 3차례에 걸쳐 위탁대금 4,378,000원(= 계약금액 3,980,000원 부가세 398,000원)을 모두 지급하였다.

At the time, the Defendant operated the business of maintaining and repairing air conditioners with the trade name of “F” (hereinafter referred to as “F”) from the original city E and 1st floor in nuclear city, and performed the business of maintaining and repairing air conditioners in the G area of the SK Telecom Co., Ltd. (hereinafter referred to as “SK”).

C. On April 25, 2014, the Plaintiff leased KRW 5 million to the Defendant as of June 30, 2014, and received a certificate of borrowing from the Defendant.

기술부문을 담당하던 C이 2014. 12. 30. D를 퇴사하자, 원고는 피고에게 D가 추진 중인 에너지절감기 개발업무를 담당해줄 것을 제안하였고, 이에 대하여 피고는 위 개발업무에 관하여 연봉 4,000만 원과 에너지절감기 테스트용 쳄버룸구축을 요구하는 한편, 자금난을 겪고 있던 피고의 F의 사업자금으로 사용할 7,000만 원 정도를 대여해달라고 요구하였다.

E. The Plaintiff loaned to the Defendant KRW 18 million on March 10, 2015, KRW 5 million, and KRW 13 million on December 13, 2015, and thereafter lent to the Defendant a certificate of borrowing KRW 18 million from the Defendant on March 13, 2015 (= KRW 5 million), ② the same year

To lend KRW 7.5 million on October 14, 2015 and KRW 6.5 million on April 14, 2015, the loan certificate for KRW 14 million from the Defendant (= KRW 6.5 million) on April 14, 2015; ③ to lend KRW 10 million on June 11, 2015, the loan certificate for KRW 10 million from the Defendant on June 19, 2015; and ④ to lend KRW 10 million on July 11, 2015, the loan certificate for KRW 10 million was respectively issued from the Defendant on the same day.

The plaintiff and the debtor are named as the defendant.
