Reasons
Punishment of the crime
[Criminal Power] On April 10, 2015, the Defendant was sentenced to one year of fraud and imprisonment for breach of trust at the Jeonju District Court on April 17, 2015, and the said judgment became final and conclusive on April 17, 2015.
【Criminal Facts】
1. Around February 15, 2013, the Defendant committed a crime related to the 30-year number system of 30 million won, organized 23 community members, including the victim F, G, the same H, H, the same I, K, the same J, K, the same L, the same L, the same M, the same M, and N, and 30 old accounts, as if the Defendant paid the deposit amount of 1 million won per each month at the “E Center” located in M, Busan-gu, Seoul-si, Seoul-si, Seoul-si, as if the Defendant would normally pay the deposit amount of 1 million won per month in the prescribed order.
However, the facts are as follows: (a) the Defendant had a debt owed at the time, approximately 300 million won; (b) the Defendant had a debt owed at the time; (c) the Defendant had a debt owed at the time; (d) the Defendant had a debt owed at the same time as the credit held on February 15, 2013; and (e) the Defendant had a credit number of KRW 41 million, which was operated at the same time as the credit held on March 15, 2010; (d) the credit number of KRW 35 million, which was composed of 41 old accounts; and (e) the credit number of KRW 35 million, which was made on April 15, 2011; and (e) the Defendant did not have an intent to pay the credit amount to the members in a so-called way as to the credit number of KRW 35,00,000,000, including the credit amount paid by the credit members on February 15, 2013.
Around February 15, 2013, the Defendant made a false statement to the effect that “the E Center should operate a normal system and pay a fraternity to the victim F,” and that is, the Defendant received a total of 7 million won from the victim F to March 20, 2014, a sum of 500,000 won per month from the victim F to the victim’s payment, in total, 150,000 won, from the nine victims as shown in the attached crime list 1, for the same period.
