The defendant's KRW 3,00,000 and its interest to the plaintiff shall be 5% per annum from June 1, 2019 to December 16, 2020.

Basic Facts

The Plaintiff served as B and as C public officials from March 1, 1968 to December 31, 1981, and served as D Corporation employees from January 1, 1982 to end of January 1, 1999. From March 1, 2006 to September 26, 2010, as contract public officials belonging to Seoul Metropolitan Government, from September 27, 201 to February 27, 201, as the part-time fixed-term public officials belonging to E-type public officials of Seoul Metropolitan Government (hereinafter referred to as “public officials subject to the fixed-term public officials of office period system”) and from March 16, 201 to May 31, 2019, respectively, as public officials belonging to the Jung-gu Seoul Metropolitan Government.

The defendant is a corporation established with the aim of contributing to stabilizing the lives and improving the welfare of the public officials and their bereaved families by efficiently implementing the projects under the Public Officials Pension Act.

When the Public Officials Pension Act was amended on March 20, 2018 and enforced on September 21, 2018, and a term-based public official was included in the Public Officials Pension Act subject to the application of the Public Officials Pension Act. On October 16, 2018, the Plaintiff received a written reply from the Defendant’s counseling center that “where adding the former public official’s service period to the Plaintiff’s service period, the Plaintiff would have the amount of retirement benefits to be returned to the Defendant.” On March 19, 2019, the Plaintiff received an answer that the Plaintiff would be able to provide a guidance on the amount of the retirement benefits to be returned to the Defendant for adding the service period to the Defendant. On March 26, 2019, the Plaintiff was approved to add the service period from the Defendant on March 26, 2019, and the amount of the retirement benefits returned therefrom would have been KRW 63,12

At that time, the Plaintiff confirmed that the expected retirement pension amount was KRW 170,050,840 in lump sum or monthly payment was KRW 2,612,940 on the Defendant’s website by inquiring about the expected retirement benefit amount of the Plaintiff on the Defendant’s website, and confirmed that the expected retirement pension amount was KRW 170,050.

After that, on March 28, 2019, the plaintiff could actually receive the above amount when the plaintiff retires from office by calls from the defendant's counseling center.
