Punishment of the crime

[Criminal Power] On October 10, 2019, the Defendant was sentenced to one year of imprisonment with prison labor for a special injury, etc. at the Daegu District Court, which became final and conclusive on November 22, 2019.

【Criminal Facts】

1. Fraud;

A. On December 25, 2018, the Defendant referred to “C” as “C” to the victim B from the French land, and falsely speaks that “C has a blick photograph of a width, and spread it on the Internet. In order to prevent the spread of a photograph, the Defendant would deliver money to B on his/her own.”

However, even if the defendant received money from the victim, he did not have any intention or ability to prevent the spread of the victim's photograph by delivering it to C.

The Defendant, as such, by deceiving the victim, received 50,000 won from the victim to the post office account (E) in the name of D, and received 560,000 won in total from the victim through the same method until January 19, 2019.

B. On January 25, 2019, the Defendant made a false statement to the effect that “The account is prevented. I would like to raise money to thener by withdrawing money from the account. I would like to make a false statement.”

However, even if the defendant received money from the victim, he did not have the intention or ability to pay money to the victim by using the suspended account.

As such, the Defendant, by deceiving the victim as such, received KRW 100,000 from the victim one bank account (F) in the name of D from the victim on the same day, from that time until February 18, 2019, received a total of 2,850,000 won from the victim in total over 10 times, as shown in the attached Table 2 of Crimes List 2.
