피고인은 2013. 2. 24. 19:00경 성남시 분당구 C에 있는 지하철 D역 내 에스컬레이터에서, 짧은 치마를 입고 있는 성명불상의 여성 피해자를 발견하고 그녀의 뒤에 접근하여 소지하고 있던 피고인의 스마트폰(SKY베가레이서)의 동영상 촬영기능을 켠 후 위 피해자의 치마 밑을 조준하여 다리 뒷부분을 동영상 촬영하는 등 그때부터 2013. 6. 14. 09:30경까지 위와 같은 방법으로 아래 범죄일람표 기재와 같이 총 9회에 걸쳐 성명불상의 여성 피해자들의 신체를 촬영하였다.
