Defendants shall be punished by a fine of KRW 5,000,000.

The Defendants did not pay each of the above fines.

Punishment of the crime

Defendant

A is a person who registered as a candidate for C/Gun preliminary candidate going out of the nationwide provincial election on April 1, 2018, and registered as a candidate for C/Gun on May 24, 2018. On June 13, 2018, the seven-time nationwide local election implemented on June 13, 2018, went out as a candidate for C/Gun, and the defendant B was elected as a member of C/Gun on June 4, 2014 and was elected as a member of C/Gun from July 1, 2016 to June 30, 2018, while serving as a member of C/Gun from July 1, 2016 to June 30, 2018.

No person shall publish or have a candidate publish false facts with respect to a candidate, his/her spouse, lineal ascendant or descendant, or sibling, in a manner unfavorable to the candidate through a speech, broadcast, newspaper, communication, magazine, poster, propaganda document, or any other means, with the intention of prohibiting him/her from being elected

On April 10, 2018, the Defendants stated in Defendant B’s house located in Gangwonwon D, that “C head of Gun E is publicized as if Defendant A fully repaid the obligation of the CF, but CF borrowed 10.3 billion won at an interest rate while carrying out a sewage treatment project, and shall pay an interest of KRW 7.7 billion for twenty (20) years.” On April 10, 2018, Defendant B entered in Defendant B’s office of the CF’s office located in Gangwon F in the second upper end of the election campaign material by computer in the second upper end of the election campaign material of the CF, namely, “The Gun’s snow and ear belong to the military, absolute,” and “the truth that our military is hidden or true,” and Defendant B has repaid the following parts.
