The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal that the court below rendered is too unhued and unreasonable.

In full view of all the circumstances such as the Defendant’s age, character and conduct, occupation, environment, circumstances leading to the instant crime, and circumstances after the instant crime, etc., the Defendant’s determination of the facts charged in this case is deemed to be unfair because the sentence of the lower court is too unreasonable, and thus, the Prosecutor’s aforementioned assertion is without merit.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
