Defendant shall be punished by a fine of two million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

[2019 Highest 1048] On October 8, 2018, the Defendant sent a letter to the victim D’s request for the production of a product page by accessing B carpet C, and made a false statement to the victim that “on the advance payment, it will produce a page.”

However, even if the defendant receives a prior payment, he did not have the intention or ability to produce a product page.

The Defendant, by deceiving the victim as such, received KRW 50,00 from the victim’s account in the name of the E bank on the same day.

[2019 Highest 1049] On September 19, 2018, the Defendant visited B Kaf F, and made a false statement to the effect that “I would create things on the part of the sending of money” by visiting the victim G, and by visiting the victim.

However, even if the defendant receives money from the victim, he did not have the intention or ability to produce the above goods.

As such, the Defendant, by deceiving the victim, transferred KRW 10,00 on September 20, 201 from the victim’s account in the name of the Defendant to the E bank account under the name of the Defendant, and received KRW 50,000 on September 27, 2018 under the pretext of additional money, and received KRW 615,000 on total three occasions, such as remittance of KRW 465,00 on October 1, 2018.

[2019 Highest 1161] On October 26, 2018, the Defendant reported that “a request for the production of a marriage-based animation video,” which was connected to BKafF and posted by the victim H, was falsely called “a request for the production of animation video” to the victim and “a request for the production of animation video shall be made within one month from the second week on the face of the transfer of money.”

However, even if the defendant received money from the victim, he did not have the intention or ability to produce the above images within the period of promise.

As such, the Defendant, by deceiving the victim, received 50,000 won from the victim’s account under the name of the Defendant to the E bank account on October 28, 2018, and the post office in the name of I on December 18, 2018.
