Reasons
1. Basic facts
A. The Seoul Jongno-gu E-Wing-7,900.80 square meters to implement the housing reconstruction improvement project on December 24, 2002, Defendant DIB (hereinafter “Defendant Association”) prior to amendment by Act No. 11293, Feb. 1, 2012 to the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents to implement the housing reconstruction improvement project.
The Act on the Maintenance and Improvement of Urban Areas (hereinafter referred to as “Urban Improvement Act”).
Pursuant to the head of Jongno-gu Seoul Metropolitan Government (hereinafter referred to as the “head of the Gu”).
(B) The Plaintiffs are owners of lands, etc. in the said project zone. B. The Defendant Union established a project implementation plan on March 14, 2005, which was authorized by the head of the Defendant Association, and established a management and disposal plan based on the application for parcelling-out from the members of the Plaintiff, and approved by the head of the Defendant on September 25, 2006 (hereinafter “the first project implementation plan”) and the first management and disposal plan.
(1) The main contents of the initial project implementation plan and the initial management and disposal plan are as follows: (1) the project implementation period of the initial project implementation plan as of March 14, 2005 (2005.3.2) to June 2008, the name of the building site for facilities other than E- 12,874 million won for project expenses, and the name of the building site for facilities other than E- 12,823.20, and the building area for facilities other than E- 1,496.46, and 25,319.36, and the building area for facilities other than E- 1,49.36, and the building area for 8,741.10 (%) 13.9.91, the highest height of 41.25 stories for 41.25 stories and 25 stories for facilities other than E-179, 485.25 stories for residential facilities and 35 stories for residential facilities (20.35 stories)
