The prosecutor's appeal is dismissed.

1. The judgment of the court below which dismissed the prosecution of this case on the ground that it is difficult to see that a person who suffered damage from the gist of the grounds for appeal is not subject to punishment in an investigative agency as conclusive, is erroneous in the misapprehension of facts

2. The victim expressed his/her wish not to punish the defendant at an investigative agency in light of the details of the statement to the investigative agency of the victim, the details of the statement, and the progress of the investigation;

As such, the prior prosecutor's assertion is rejected on a different premise.

3. According to the conclusion, the prosecutor’s appeal is dismissed pursuant to Article 364(4) of the Criminal Procedure Act, and it is so decided as per Disposition.
