The judgment of the court below is reversed.

A defendant shall be punished by imprisonment for six months.

However, the above punishment for a period of two years from the date this judgment became final and conclusive.

1. The sentence imposed by the court below on the defendant (six months of imprisonment) is too unreasonable.

2. In light of the fact that the accused committed a single crime and committed a second or more criminal punishment, even though he/she had been subject to suspended sentence, it is necessary to strictly punish the accused.

그러나 피고인이 범행을 모두 시인하며 반성하고 있는 점, 피고인의 혈 중 알코올 농도 및 피고인에 대한 주 취 운전자 정황 진술보고서의 내용에 비추어 보면, 피고인이 직업상 들른 거래처에서 우연히 소량의 막걸리를 마시게 되었고, 그 후 상당한 시간이 경과하여 술이 깼을 것으로 만연히 생각하고 운전을 하는 바람에 이 사건 범행에 이르게 되었다는 피고인의 변소가 납득이 가는 점, 상당기간의 구금 생활을 통하여 충분한 자숙과 반성의 시간을 가졌을 것으로 보이는 점 등 피고인에게 유리한 정상이 있고, 그 밖에 피고인의 나이, 성 행, 환경, 범행동기, 수단과 결과, 범행 후 정황 등 제반 양형조건들을 종합하면, 원심 형량은 너무 무거워서 부당 하다고 인정된다.

3. As such, the defendant's appeal is with merit, and the judgment of the court below is reversed pursuant to Article 364 (6) of the Criminal Procedure Act, and the defendant's appeal is again decided as follows.
