A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
1. Around September 13, 2013, the embezzlement Defendant concluded a lease agreement with the content that “The Defendant will faithfully pay KRW 4,499,508 per month at rent for 36 months,” with respect to one machine learning center equivalent to KRW 176,000,000 at the market price, at the office of E, the Defendant’s operation of Defendant D located in Busan Seo-gu, Busan, and between the victim NonSg Capital and the victim Non-Sgion Co., Ltd.
Around October 2014, the Defendant was kept in custody for the damaged company, which is the ownership of the victimized company, at the above factory E Co., Ltd., the Defendant arbitrarily disposed of it to a third party and embezzled it.
2. “2015 Highest 1173”: around January 27, 2012, the Defendant entered into a lease agreement with the victim, stating that the Defendant would pay each month rent of KRW 9,853,841 to the victim for 36 months at the said office, “2 MM925 L, 206, VM844, 2012,” and “MM960, 2000, 2000, 2000, 2000, 2000, 2000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000).

The Defendant was employed by the foregoing company on October 1, 2010 and served as a vice head of a business team.
