1. The Defendant (Counterclaim Plaintiff) and Defendant E are jointly and severally liable to the Plaintiff.

A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. Basic facts

A. On July 7, 2005, the Plaintiff purchased, sold, and sold each of the buildings of this case. 1) The Plaintiff purchased, sold, and sold land G to the F on July 7, 2005 (hereinafter “instant land”).

(2) Each of the instant buildings located on L and M’s ground, but most of the instant land exists on the instant land as indicated in drawings 2, and the Plaintiff claimed to specify only the land portion related to the instant land. As such, the aforementioned L and M’s land portion are not separately mentioned. When selling each of the instant buildings to KRW 3,600,000,00, and the F and H (the Plaintiff’s punishment) agreed to register title trust with H on July 29, 2005, H completed the registration of title transfer on the ground of donation with respect to the instant land and each of the instant buildings under H’s name on the same day on the same day. Then, H decided to terminate the registration of title transfer with F and the aforementioned title trust agreement on the portion of 530.71/536.08 of each of the instant buildings on March 23, 2007.

F had completed the registration of ownership transfer on August 28, 2008 with respect to the share in one’s own name (530.71/536.08/53) among each of the instant buildings to I.

3) Meanwhile, on January 9, 2005 with respect to the instant land and each of the instant buildings, the procedure for the commencement of voluntary auction was commenced by the court J on January 9, 2005, and the registration of the voluntary decision on commencement of auction was cancelled on December 11, 2009 due to the decision on revocation on July 28, 2009. As to the instant land, the registration of the voluntary decision on commencement of auction was completed on February 22, 2010 on the same day as the sale due to voluntary auction on February 22, 2010. (B) The Plaintiff filed a claim against H and F on August 17, 2009 against the instant court against H and F, etc. for the cancellation of ownership transfer registration under the name of H on July 29, 2005, and the name of F on March 23, 2007.
