A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around 05:30 on June 16, 2013, the Defendant driven CMW car under the influence of alcohol concentration of about 0.097% without obtaining a driver’s license on a section of about 500 meters from the road near the new industrial tower in Ulsan-gu, Ulsan-gu to the front road in front of the mountain.

2. The Defendant in violation of the Act on Special Cases concerning the Settlement of Traffic Accidents is a person who is engaged in driving of CMW automobiles.

On June 16, 2013, the Defendant driven the above car at around 05:30, and driven the three-lane road in front of the Ulsan-gu New-dong, Ulsan-gu, Ulsan-gu, Ulsan-do, along the three-lanes from the industrial tower-side area to the reduction tree dust distance.

Since there is a center line of the main yellow domin line, a person engaged in driving a motor vehicle has a duty of care to thoroughly operate the front line and to keep it safely.

그럼에도 피고인은 술에 취하여 이를 게을리 한 채 오른쪽 도로 연석을 들이받고 그 충격으로 왼쪽으로 튕겨져 나가 피고인의 왼쪽 차선인 2차로에서 직진 중이던 피해자 D(51세)이 운전하는 E 매그너스 승용차의 조수석쪽 앞 휀다 부분을 위 BMW 승용차 왼쪽 앞 범퍼 부분으로 들이받고 계속하여 중앙선을 넘어, 반대 편 도로에서 직진 중이던 피해자 F(41세)이 운전하는 G 싼타페 승용차의 앞 범퍼부분을 위 BMW 승용차 앞 범퍼로 그대로 들이받았다.

Accordingly, the Defendant’s negligence caused the injury to the victim H(29 years of age) who was on board the same vehicle due to the above occupational negligence for about two weeks, and caused the injury to the victim D, who is a driver of the said vehicle, for about three weeks of medical treatment, such as light oil and salt, which requires approximately six weeks of medical treatment, and requires approximately six weeks of medical treatment to the victim F, who is a driver of the said vehicle.
