1. The Defendant shall pay to the Plaintiff KRW 58,802,827 and the interest rate of KRW 17% per annum from September 28, 2019 to the day of full payment.
Reasons
1. Determination on the cause of the claim
A. On or around June 2016, the Plaintiff entered into a sales contract with the Defendant for the sale of the C-building D (BT and the sale area of 38.19 square meters) at KRW 126,578,380 of the sale price (hereinafter “instant sales contract”). According to the instant sales contract, according to the instant sales contract, the Defendant: (a) divided the sale price into the sales price and KRW 12,657,830 as the down payment on April 19, 2016; (b) the first part of the intermediate on August 1, 2016; (c) the second part of the intermediate on December 2, 2016; and (d) the third part of April 3, 2017.

The payment of KRW 12,657,830, respectively, by the intermediate payment on December 5, 2018, and by the sixth intermediate payment on March 6, 2018, and by the payment of KRW 37,973,490, respectively. The Defendant paid the late payment and the delayed payment at the rate of 17% per annum. However, the Defendant paid the late payment and the delayed payment at the rate of 17% per annum. Accordingly, the Defendant paid the late intermediate payment and the outstanding payment at the rate of 58,802,827 (i.e., the remainder of KRW 6 intermediate payment at KRW 37,973,973,490 (i.e., the late payment at KRW 12,657,830), and the late payment at the interest rate of KRW 1,976,702, 370,735, 6375, 240, and property tax payment at the KRW 148308).
According to the above facts of recognition, the defendant is obligated to pay the plaintiff interest in arrears calculated by the rate of 17% per annum from September 28, 2019 to the date of full payment, which is the day following the service date of the original copy of the payment order, to the day of service of the original payment order.
B. The defendant asserted that since the contract for sale in this case was cancelled, the defendant does not have an obligation to pay the intermediate payment, etc., but there is no evidence to acknowledge the above argument.
2. The plaintiff's claim is justified.
