1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. The status of the original Defendant is that the Plaintiff is a male born B, and is currently enrolled in the fourth grade of the master’s degree course at C University Medical School (hereinafter “the instant Council member”). In the event that the Plaintiff satisfies the requirements for graduation, the Plaintiff would have graduated from February 2020.
The defendant is an administrative agency that manages military service resources in the city where the plaintiff is his domicile.
B. On November 11, 2008, the Plaintiff was assigned to enlistment in active duty service on the ground that the Plaintiff was assigned to Grade II and was assigned to enlistment in active duty service. From March 1, 2009 to November 13, 2013, the enlistment was postponed on the ground that he was enrolled in a four-year college. On the other hand, on November 4, 2013, the Plaintiff was assigned to enlistment in active duty service after having been assigned to Grade II and a second-class military service after having been assigned to enlistment in active duty service on the ground that he was transferred to a university or a graduate school from June 16, 2014 to May 31, 2015, and the Plaintiff postponed the enlistment on the ground that he was transferred to the university and was assigned to a graduate school from November 30, 2015 to January 11, 2016.
3) After the Plaintiff entered the main body and the first grade of the Council in 2016, the enlistment was postponed due to the Plaintiff’s enrollment in the said Council members from March 1, 2016 to November 29, 2017. After the lapse of 28 years of age, the age limit for postponement on the ground of the Plaintiff’s enrollment at the graduate school of medical science, the Plaintiff was two times of enlistment due to the Plaintiff’s application for national announcement from March 5, 2018 to September 14, 2018 (Grade 9, National Assembly Officials’ Examination, National Assembly Officials’ 9, and National Assembly Officials’ 9), from November 5, 2018 to November 3, 2019.
