1. The part of the Plaintiff’s lawsuit against the Plaintiff B’s “liability assumption” and the Plaintiff’s lawsuit against the Plaintiff A are dismissed.

2. The defendant is the plaintiff.

Facts of recognition

Except for the goods G subject to the contract of the plaintiffs and the defendant, 39 households (Hhos, I, Jhos, K, M,Ohos, P, Q, Q, Shos, Thos, V, W, X, X-Y, Y, AAhos, ABhos, AChos, AChos, ADhos, AE, AF, AHhos, AI, AJhos, AK, AK, ALhohohos, AMhos, Nhohos, APhos, Qhos, APhos, AShos, and ATS, by April 15, 2018, the purchase price of KRW 5,270,00,000 shall be paid until April 15, 2018.

(C) Any balance remaining after succession to the loan (59,600,000 won) agreement

2. It shall purchase a loan of D.D. (D.D.) by succession to KRW 4,670,400,000.

3. Any balance remaining after a loan is succeeded, 599,600,000 won shall be paid by the buyer; and

5. The purchaser shall transfer the ownership by April 30, 2018.

10. The interest on the current loan shall be borne by the buyer from March 15, 2018.

The Plaintiffs shared 1/2 shares of each E-ground collective housing, including each real estate listed in the separate sheet. On March 15, 2017, each of the E-ground collective housing was entrusted to F Co., Ltd., and sold to the Defendant on December 9, 2017. The main contents of the sales contract are as follows:

(hereinafter “instant sales contract”). The Defendant acquired the ownership transfer registration and the obligation for the loan from the Defendant with respect to the Defendant’s certain households, from the Plaintiff, the obligation of KRW 3,485,90,00 for the said households among the obligation of the D Association loans was completed by the Plaintiff, and the Defendant acquired the ownership transfer registration with respect to the said households among the obligation of D Association loans of KRW 29 households. The obligation of KRW 3,485,90,00 for the said households was completed by the Plaintiff.

However, the defendant did not acquire the registration of transfer of ownership for the remaining 10 households (each real estate listed in the attached list) from the plaintiff, and did not have any obligation for the loan.

B-on or after March 15, 2018, Plaintiff B paid interest after March 15, 2018, with interest rate of April 4, 2019, KRW 4,527,061, and interest rate of May 2, 2019, KRW 4,381,027, interest rate of June 4, 2019, KRW 527,061, and KRW 4,527,061, and July 2019.
