피고인은 2014. 10. 29. 21:46경 청주시 청원구 D에 있는 ‘E’ 호프집에서, “술에 취한 사람이 들어와 주문하지 않은 채 소파에서 잠을 자고 있다”라는 112신고를 받고 출동한 청원경찰서 F파출소 소속 경사 G(48세)과 경위 H이 자는 피고인을 깨우자, “뭐여 이 씹새끼, 좃까고 있네”라는 등 욕설하고, 주먹으로 경사 G의 얼굴을 향하여 때리는 시늉을 하는 등 약 10분간 소란을 피우고, 같은 날 21:55경 경사 G과 경위 H이 피고인을 데리고 위 호프집을 나가려고 하자, 갑자기 양손으로 경사 G의 멱살을 움켜쥐고 “아이 씨부랄새끼, 못가겠다”라고 욕설하면서 경사 G을 도로에 주차된 승용차 쪽으로 세게 밀어 그 승용차에 부딪히게 하였다.
