A defendant shall be punished by imprisonment for a term of one year and two months.
Reasons
Punishment of the crime
On September 25, 2015, the Defendant sentenced two years to imprisonment for habitual larceny at Seoul High Court (Seoul High Court) on November 4, 2015; imprisonment for one year and six months to the same offense; and on November 29, 2016, the Suwon District Court sentenced three years to imprisonment for violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Suwon District Court on September 19, 2019.
1. On July 10, 2020: (a) around 05:10 on July 10, 2020, the Defendant: (b) around 05:10, at the third floor parking lot of the Gangnam-gu Seoul Metropolitan Government B apartment Cdong; (c) took advantage of the fact that there is a door of the victim D’s Epomera car located in that area, the Defendant carried 1,80,000,000 won in the market price owned by the victim located in the car and carried out 70,000 won in cash.
2. On July 10, 2020, the Defendant: (a) around 04:07, at the first floor parking lot of Gangnam-gu Seoul Metropolitan Government B apartment Cdong-dong, the Defendant opened a door by using the victim F’s G color translating in that place and colored the draft, but failed to discover stolen objects.
3. On July 10, 2020, the Defendant: (a) around 04:08, at the parking lot of the Gangnam-gu Seoul Metropolitan Government B apartment Cdong, the Defendant: (b) opened a door using the fact that there is a door of the victim H, parked therein; and (c) colored the draft, but failed to discover stolen objects.
4. On July 10, 2020, the Defendant: (a) around 04:16, at the first floor parking lot of Gangnam-gu Seoul Metropolitan Government B apartment Cdong, the Defendant opened a door using the fact that there is a door of the victim J, parked therein, and colored the draft, but failed to discover stolen objects.
5. On July 10, 2020, the Defendant: (a) around 04:16, at the third floor parking lot of the Gangnam-gu Seoul Metropolitan Government B apartment Cdong, the Defendant opened a door by using the victim L, which was parked therein, the text of which is opened; and (b) colors the draft, but stealss.
