Reasons
1. Basic facts
A. C Co., Ltd. (hereinafter “C”) created a general industrial complex at Dawon-gun, Chungcheongnam-gun, Chungcheongnam-do. On July 5, 2016, on the following grounds: (a) 9291m2 (hereinafter “1m2”); (b) 9917m2 (hereinafter “2m2”); and (c) 22369m2 (hereinafter “3m2; 1, 2, and 3m2) of G factory site in the name of C with respect to each land of this case: (a) on the following grounds: (b) on July 5, 2016, the Defendant completed registration of preservation of ownership in the name of C with respect to each land of this case: (c) on the sectional superficies or lease for the construction and ownership of electric structures on the land before creating a general industrial complex; (d) on May 19, 2016, the Defendant did not register the change of divided superficies from C’s sectional superficies development project under the name of “H on May 16, 2016.
‘The proposal' was received.
After that, on June 30, 2016, the Defendant entered into a contract to establish superficies and divided superficies on each of the instant land with C and C, and completed the registration of creation of superficies and divided superficies under the name of C on July 5, 2016, on which C completed the registration of preservation of ownership. The content of each of the instant land is as follows.
