1. The part concerning the claim for removal in the lawsuit of this case shall be dismissed.

1. The purport of the claim in a civil lawsuit regarding the part of the lawsuit of this case should be clearly identified in a way that the contents and scope of the claim can be clearly identified. Since whether the claim is specified in an ex officio investigation, where the purport of the claim is not specified, the court shall order the correction ex officio regardless of the defendant's objection, and dismiss the lawsuit in case where the defendant does not comply with the order of correction.

Of the instant lawsuits, it is difficult to see that the content and scope of the removal subject matter are unclear and specifically specified. This Court expressed its intention to maintain it as it is, even though it pointed out to the Plaintiff’s agent that it is necessary to specify the removal subject matter on the second date for pleading.

Therefore, the part of the claim for removal among the lawsuits of this case is unlawful because the purport of the claim is not specified.

2. Confirmation of the right of passage over surrounding land and determination of the claim for the prohibition of passage over surrounding land

A. Basic facts 1) On September 30, 2013, the Plaintiff is deemed to be the 487-2 amusement park, 864m2, 487-3 amusement park, 17,328m2, 50 forest land, 2,085m2, 51 forest land, 3,488m2 (hereinafter “each land of this case”).

(2) On October 15, 2013, the Plaintiff purchased each of the instant lands in a voluntary auction procedure, and completed the registration of ownership transfer in the name of the Plaintiff. On each of the instant lands, the land of this case was created by the 29-party 29-party 1, Chungcheong Skyal Royal Roc Gac Gac Gac Gac Gac Gac Gac Gam. (hereinafter “Defendant-owned land”). The Defendant acquired the land of this case by public sale on May 11, 2004 and completed the registration of ownership transfer thereof.

On the land owned by the defendant, the building of the Chungcheong Houri hotel (which falls under the lower part of the left part of the forest below) is constructed.
