A defendant shall be punished by imprisonment for two years.

Punishment of the crime

[2] On April 26, 2010, the Defendant was sentenced to imprisonment with prison labor for a violation of the Punishment of Violences, etc. Act (Habitual Bodily Injury) at the Daejeon District Court, and on February 19, 2013, the Defendant was sentenced to imprisonment with prison labor for a violation of the Punishment of Violences, etc. Act (joint injury) at the same court on February 19, 2013, and on February 13, 2015, the Defendant was sentenced to imprisonment with prison labor for a violation of the Punishment of Violences, etc. Act (collective, deadly Intimidation, etc.) at the Gwangju District Court Support, and completed the execution of the sentence on October 12, 2015. On July 14, 2016, the Defendant was sentenced to imprisonment with prison labor for a special injury and completed the execution of the sentence on November 30, 2017.

[Criminal facts]

1. On April 1, 2018, the Defendant: (a) around 20:0, the facts in the “E” restaurant operated by the victim D (V, 56 years of age) located in Daejeon-gu Daejeon-gu, Daejeon-gu; (b) despite having no intent or ability to pay the price, the Defendant was aware that he/she would have paid the price despite the absence of an intent or ability to do so; and (c) was provided with 33,000 won of the amount of KRW 33,00 of the damages.

2. Violation of the Punishment of Violences, etc. Act (Habitual injury) and violation of the Punishment of Violences, etc. Act (Habitual assault).

A. On May 7, 2018, the Defendant, at the center of Daejeon-dong, Daejeon-gu, Daejeon-gu, 215, performed drinking with the victim F (47 years of age) in the smoking area near the Dong-gu, Daejeon-gu, Daejeon-gu, 2018, while drinking alcohol with the victim’s drinking expenses, and assaulting the victim’s left side by walking the safety while walking the victim’s vision.
