1. The plaintiff's claim is dismissed.

Details of the disposition

The plaintiff is a male student in the second grade of the D Middle School in Songpa-gu Seoul Metropolitan Government, E is a male student in the second grade of the FJ in Hongcheon-gun, Hongcheon-gun, and he was in the school of friendship from around December 2019.

On May 28, 2020, the Defendant held the committee for deliberation on countermeasures against school violence (hereinafter “Deliberation Committee”) jointly with the head of the Gangwon-do Hongcheon District Office of Education on May 28, 2020 on the following acts (hereinafter “instant grounds”), and on June 2, 2020, issued a decision to the Plaintiff on June 2, 2020 pursuant to Article 17(1)2, 8, and (3) of the Act on the Prevention of and Countermeasures against Violence in Schools (hereinafter “Act on the Prevention of Violence in Schools”), a disposition of contact, intimidation, and retaliation, transfer, and special education (hereinafter “instant disposition”).

On April 10, 2020, E takes a image of panpanty and downloads it into a photographic file (hereinafter “the exposure photograph of this case”). On April 10, 202, the disposition of this case threatens to spread the exposure photograph of this case to others unless he/she does not act with E over 11 times from April 10, 2020 to April 21, 2020. On April 17, 2020, the disposition of this case sent the motion picture of this case to female-friendly I using the message of the Facebook of this case, sent the motion picture of this case to E on April 21, 2020 without paying two times the amount to E, and then sent the picture of this case to E [this case’s assertion that there is no ground to believe that he/she does not respond to the entire disposition of this case], and thus, the Plaintiff’s assertion that he/she does not respond to the resolution of this case’s motion.

In addition, the reason of this case is not done within the school, and it is necessary to transfer the plaintiff to another school and separate it from E.
