1. On October 22, 2012, the Defendant made a telephone call to the victim C, and the Defendant stated to the effect that “I would complete payment after this mold if I would lend KRW 600,000, as I need to agree that I would have received a complaint from the Busan Police Station with human beings.”
However, even if the defendant borrowed money from the victim, he did not have the intention or ability to repay it.
The Defendant received 600,000 won from the victim to the Defendant’s account under the pretext of borrowing money on the same day.
Accordingly, the defendant was given property by deceiving the victim.
In addition, the Defendant received from the victim the total amount of KRW 4,806,000 from March 7, 2013 to March 10, 2013, as indicated in the list of crimes, the Defendant received property worth KRW 4,806,000 from the victim every eight times.
2. On December 31, 2012, the Defendant used computers, etc.: (a) around 10:00, the Defendant: (b) stated the instant physical card in the victim’s account in the cash payment instrument managed by the Defendant, and transferred KRW 130,000 from the victim’s account to the Defendant’s account, to the effect that “Apin’s money is changed” was changed to “Apin’s money.” (c) In lieu of cash in this name, the Defendant obtained the instant physical card from the female to the Defendant’s account. (d) On December 31, 2012, the Defendant transferred the victim’s account from the victim’s account.
Accordingly, the defendant acquired economic benefits equivalent to 130,000 won by inputting information into a computer or any other information processing device without authority.
3. Larceny;
A.
